Terms & Conditions
These Terms and Conditions (“Terms”) govern your membership in and use of WellHour, the private Pilates studio operated by Well Hour, LLC (“Studio,” “we,” “us,”or “our”). By signing these Terms electronically or otherwise, you (“Member” or “you”) acknowledge that you have read, understood, and agreed to these Terms, including the assumption of risk, waiver, and release of liability provisions.
1. Membership Eligibility and Enrollment
1.1 ELIGIBILITY
Membership is personal to the individual enrolled and may not be transferred, assigned, shared, resold, or used by another person.
Members must be a woman at least 18 years of age.
1.2 REQUIRED INFORMATION
Members must provide complete and accurate enrollment, contact, billing, emergency contact, and health-related information requested by the Studio, including a copy of member’s drivers license.
Members must promptly update this information through the Studio’s mobile application (the “App”) or by contacting the Studio.
1.3 INDIVIDUAL MEMBERSHIPS ONLY
The Studio does not offer household or family membership packages. Each person who uses the Studio must: (a) maintain an individual membership; (b) maintain a separate member account through our App; (c) complete the required safety orientation; (d) accept these Terms and any required waiver; and (e) access the Studio through only your account.
2. Membership Plans
The Studio currently offers the following monthly membership plans:
4 Sessions per Month: $88 per month
- Up to four sessions during each monthly membership cycle
8 Sessions per Month: $144 per month
- Up to eight sessions during each monthly membership cycle
Unlimited Monthly $211 per month
- Unlimited sessions, subject to a maximum of one session per calendar day
Applicable taxes, processing charges, or other disclosed fees may be added.
2.1 SESSION CREDITS
Session credits under the 4-Session and 8-Session plans are available only during the applicable monthly membership cycle unless the Studio expressly states otherwise in writing.
Unused session credits expire at the end of each billing cycle and do not roll over.
Credits have no cash value and may not be transferred to another person.
2.2 UNLIMITED MEMBERSHIP
An Unlimited Monthly membership is limited to one session per calendar day.
“Unlimited” does not guarantee the availability of any particular date, time, equipment, or session. All sessions remain subject to advance booking and Studio capacity.
2.3 PLAN CHANGES
Requests to change membership plans must be submitted via app or email to hello@wellhour.co. Approved changes will take effect at the beginning of the next billing cycle.
3. Monthly Billing and Payment Authorization
3.1 RECURRING MONTHLY PAYMENT
Memberships are billed monthly. By purchasing a membership, you authorize the Studio and its payment processor to charge your selected payment method for (a) recurring monthly membership dues; (b) late cancellation and no-show fees; (c) charges for damaged equipment or property where permitted; (d) applicable taxes; and (e) other charges that you separately authorize or that are clearly disclosed under these Terms.
Your membership will continue on a month-to-month basis until canceled in accordance with Section 11.
3.2 BILLING DATE
Your payment method will ordinarily be charged 30 days from the date you check into your first session. If a billing date falls on a date that does not occur in a particular month, the charge may be processed on the following day.
3.3 PAYMENT INFORMATION
You must maintain a valid payment method on file. If a payment is declined or reversed, the Studio may (a) notify you and request an updated payment method; (b) retry the charge; (c) suspend booking and Studio access; and (d) terminate the membership if the balance is not paid within five days.
Suspension of access does not waive amounts already owed.
3.4 PRICE CHANGES
The Studio may change membership prices by providing at least 30 days’ advance written or electronic notice. If you do not agree to a price change, you may cancel your membership before the new price takes effect.
4. Studio Hours and Availability
Regular session availability is:
Monday–Friday 5:00 AM–9:00 PM
Saturday–Sunday 5:00 AM–1:00 PM
Sessions outside these hours may be available by request and only with advance approval from the Studio. Approval is discretionary and is not guaranteed. The Studio may adjust its hours or close temporarily because of holidays, maintenance, repairs, emergencies, weather, staffing, safety concerns, legal requirements, or other operational needs. When reasonably practicable, the Studio will provide notice through the App, email, or another available communication method.
5. Private Studio Access
5.1 LOCKED-DOOR STUDIO
The Studio is a private, access-controlled facility. It is not open for walk-in access.
The entrance door will remain locked except when access is electronically authorized or otherwise permitted by the Studio.
5.2 APP-BASED ENTRY
Members access the Studio through the App. An eligible Member with a valid booking may unlock the Studio door through the App beginning up to 10 minutes before the scheduled session.
A booking does not authorize entry earlier than that access window unless the Studio has expressly approved earlier entry.
5.3 ACCESS CREDENTIALS
Your App account, login information, mobile device access, and electronic door privileges are personal to you. You must not (a) share your account, password, access link, device authorization, or entry credentials; (b) unlock or hold the door for an unauthorized person; (c) permit another person to enter under your booking; (d) attempt to bypass or interfere with an access-control system; or (e) enter the Studio without a valid booking or express authorization.
You must promptly notify the Studio if you believe your account or access credentials have been compromised.
5.4 RESPONSIBILITY FOR GUESTS
Guests are not permitted unless expressly authorized in advance by the Studio. If guests are allowed, they must complete all required registration, orientation, and waiver documents before entering or using equipment.
6. Booking Sessions
6.1 ADVANCED BOOKING REQUIRED
All sessions must be booked through the App. Session availability is limited and offered on a first-come, first-served basis. Reservations begin on the hour (e.g., 7:00
AM, 8:00 AM) and Members may arrive up to 29 minutes after the hour without penalty.
6.2 ARRIVAL AND SESSION TIME
Members should arrive with sufficient time to prepare safely without interfering with another Member’s session. A session begins and ends at the reserved time, and late
arrival does not extend the session; however, Members may take any on-demand class that fits within the remaining reservation time, as long as the space is made ready for the next Member’s arrival at the top of the hour. For example, a Member arriving at 7:10 AM may partake in a 35-minute full body class and a 10-minute cool down class before ensuring their reformer and props are prepared for the subsequent Member.
6.3 STUDIO CANCELLATIONS
The Studio may cancel, move, or restrict a session because of equipment issues, maintenance, emergencies, safety concerns, or other operational needs. When reasonably practicable, the Studio will provide notice and restore an affected session credit or provide another reasonable remedy.
7. Late Cancellations and No-Shows
7.1 CANCELLATION DEADLINE
You must cancel a booked session at least 6 hours before its scheduled start time.
A cancellation made less than 6 hours before the scheduled start time is a “Late Cancellation.”
A “No-Show” occurs when you do not attend a booked session and do not cancel it before the session begins. The Studio will also treat an arrival more than 29 minutes of the designated session start time as a No-Show.
7.2 LATE-CANCELLATION FEE
Each Late Cancellation will result in a $35 fee.
7.3 NO-SHOW FEES
4-Session plan: Loss of the booked session credit and a $35 fee
8-Session plan: Loss of the booked session credit and a $35 fee
Unlimited Monthly plan: $50 fee
Fees may be charged to the payment method on file.
7.4 THREE-STRIKE POLICY
Late Cancellations and No-Shows are each considered policy violations.
A Member may incur up to two Late Cancellation or No-Show policy violations.
Upon the third policy violation, the Studio may terminate the membership without refund.
Policy violations will be counted during each membership year.
The Studio may excuse a policy violation in its sole discretion. Any exception is case-specific and does not waive future enforcement.
8. Safety Orientation and Onboarding
8.1 REQUIRED ORIENTATION VIDEO
Before using a Pilates reformer, each Member must complete the Studio’s required kiosk or App -based safety orientation video, Including the introduction to the reformer.
The Member must not bypass, skip, or permit another person to complete the orientation on the Member’s behalf.
8.2 PRIOR REFORMER EXPERIENCE NOT REQUIRED
Members are not required to have previously used a Pilates reformer. However, lack of prior experience does not relieve a Member of the responsibility to (a) complete all required onboarding; (b) review available instructions and safety information; (c) begin at an appropriate level; (d) ask questions when uncertain; and (e) stop using equipment if it cannot be operated confidently and safely.
8.3 IN-PERSON ONBOARDING
The Studio may offer or require in-person onboarding. The Studio may require a Member to complete in-person onboarding before further independent use if the Member (a) has difficulty using equipment safely; (b) has not understood or followed the safety instructions; (c) reports a condition that may require modification; (d) damages or misuses equipment; or (e) otherwise presents a reasonable safety concern.
8.4 ADDITIONAL INSTRUCTIONS
Members must review and follow all applicable (a) instructional videos; (b) App FAQs; (c) posted signs and warnings; (d) equipment labels and manuals; (e) QR-code instructions when available; (f) Studio communications; and (g) manufacturer safety instructions.
9. Use of Equipment and Facilities
9.1 MEMBER RESPONSIBILITY
You are responsible for using the Studio and its equipment carefully, properly, and only for their intended purposes. You agree to:
- Wear only grip socks while in the Studio;
- Listen to all video Pilates instruction via wireless Bluetooth headphones during your session;
- Inspect equipment for visible problems before use;
- Select appropriate resistance, spring settings, positions, and movements;
- Keep hands, hair, clothing, jewelry, and personal items clear of moving components;
- Use safety straps, stoppers, footbars, and other safety features as instructed;
- Maintain control of the carriage and other moving parts;
- Follow all posted and app-based instructions;
- Keep the exercise area clear of trip hazards;
- Ensure there is always one spring on;
- Add additional springs before removing any springs;
- Wear appropriate exercise clothing and footwear or grip socks as required;
- Stop immediately if equipment behaves unexpectedly; and
- Report suspected damage, unusual sounds, missing parts, or unsafe conditions.
9.2 PROHIBITED EQUIPMENT USE
You must not:
- Use equipment you do not understand how to operate;
- Remove, disable, alter, or reposition safety components contrary to instructions;
- Allow the carriage to slam into the frame;
- Wipe the video screens with the wipes designated for cleaning reformers;
- Attempt to repair or modify Studio equipment;
- Use damaged or malfunctioning equipment;
- Perform movements beyond your ability or contrary to safety guidance;
- Permit a child, guest, or unauthorized person to use equipment;
- Use equipment while impaired by alcohol, illegal drugs, or any substance that affects safe judgment or coordination; or
- Continue exercising while experiencing pain, dizziness, faintness, unusual shortness of breath, chest discomfort, or another concerning symptom.
9.3 UNSUPERVISED OR LIMITED-SUPERVISION ENVIRONMENT
You understand that the Studio operates as a private, App-accessed facility and that an instructor, employee, or other Studio representative may not be physically present. You accept responsibility for determining whether you can safely participate in that environment.
The Studio may terminate your membership if it determines that you are unfit to utilize the Studio’s equipment independently.
10. Health, Medical Clearance, and Member Disclosures
10.1 FITNESS TO PARTICIPATE
You represent that you are physically and mentally capable of participating safely, or that you have obtained appropriate clearance from a qualified healthcare professional.
You are encouraged to consult a physician or other qualified healthcare professional before beginning or changing an exercise program, particularly if you:
- Are pregnant or recently postpartum;
- Have a cardiovascular, respiratory, neurological, orthopedic, balance, or metabolic condition;
- Have recently experienced surgery, injury, hospitalization, fainting, or unexplained symptoms;
- Take medication that may affect exertion, balance, blood pressure, alertness, or coordination; or
- Have been advised to restrict physical activity.
10.2 DISCLOSURE OF RELEVANT CONDITIONS
You agree to disclose to the Studio any condition, injury, limitation, or change in health that may materially affect your ability to use the Studio safely. The Studio may request medical clearance before allowing you to begin or resume participation.
Disclosure does not make the Studio responsible for diagnosing, monitoring, or treating a medical condition.
10.3 NO MEDICAL ADVICE
The Studio, its owners, personnel, videos, App content, FAQs, and instructional materials do not provide medical diagnosis, treatment, physical therapy, rehabilitation, or individualized medical advice.
Fitness instruction and general safety information are not substitutes for advice from a licensed healthcare professional. You remain responsible for deciding whether to
begin, continue, modify, or stop an activity.
10.4 STOP WHEN SYMPTOMS OCCUR
You must stop exercising and seek appropriate assistance if you experience pain, dizziness, lightheadedness, faintness, nausea, unusual shortness of breath, chest
discomfort, loss of balance, or another concerning symptom.
11. Membership Cancellation and Refunds
11.1 CANCELLATION BY EMAIL
To cancel a membership, you must send a written cancellation request by email to: hello@wellhour.co with the subject line “Cancellation.”
The request should include your full name, account email address, and requested cancellation date.
Cancellation through social media, text message, an informal conversation, failure to attend, removal of the App, or cancellation of a payment card does not constitute
proper notice.
11.2 ADVANCE NOTICE
Membership cancellation requires 30 days’ advance notice. Charges scheduled before the effective cancellation date remain payable.
The Studio will provide an email confirmation after processing the cancellation. You should retain that confirmation.
11.3 REFUNDS
Membership charges, used sessions, expired credits, Late Cancellation fees, and No-Show fees are nonrefundable except where these Terms expressly provide otherwise; or where the Studio approves a refund in writing.
12. Membership Freezes and Pauses
12.1 STANDARD FREEZE
A Member may request a membership freeze or pause for up to 90 days, subject to Studio approval.
Requests must be submitted by email to hello@wellhour.co with the subject line “Membership Freeze” at least 30 days before the requested start date unless an emergency makes advance notice impracticable.
12.2 MEDICAL EXCEPTIONS
The Studio may approve a freeze longer than 90 days for a medical reason. The Studio may request reasonable documentation. Medical exceptions are reviewed individually.
12.3 EFFECT OF A FREEZE
During an approved freeze (a) studio access and booking privileges will be disabled; and (b) membership fees will not be charged. Billing will resume automatically on the approved reactivation date.
If you are Founding Member, you may lose Foundng Member status and your membership will resume at current rates.
A freeze does not retroactively remove charges, Late Cancellation fees, No-Show fees, or other balances incurred before the freeze began.
13. Emergency Procedures
13.1 IMMEDIATE RESPONSE
If you experience or observe a medical emergency, fire, threat, serious injury, or other immediate danger at the Studio:
- Call 911 immediately.
- Give the dispatcher the Studio address: 1401 Wauwatosa Ave, Wauwatosa, WI 53213.
- Follow the dispatcher’s instructions.
- If safe, unlock or monitor the entrance and direct emergency responders to the person needing assistance.
- After calling 911, send an in- App message to the Studio inbox.
- Begin the message with “911 CALL”, followed by the time of the incident.
- Include the location, people involved, observed facts, actions taken, and any other available details.
13.2 EMERGENCY EQUIPMENT
The Studio may maintain emergency and safety equipment that includes:
- A stocked first aid kit;
- An appropriate fire extinguisher;
- Smoke and carbon-monoxide detection as applicable;
- Emergency lighting;
- Clearly marked exits;
- Posted evacuation and emergency instructions;
- The Studio’s full street address and emergency contact information posted
- near the exit;
- Flashlights and other appropriate emergency supplies; and
- Incident-reporting materials.
Members must not tamper with, obstruct, relocate, or misuse emergency equipment.
13.3 NO GUARANTEE OF ASSISTANCE
You acknowledge that personnel or other Members may not be present during an emergency. The availability of emergency equipment does not guarantee that a trained person will be present or that assistance will be successful.
14. Assumption of Risk
Pilates, reformer exercise, stretching, strength training, and use of fitness equipment involve inherent and other risks. These risks may arise from physical exertion,
equipment movement, incorrect settings, loss of balance, falls, collisions, muscle fatigue, preexisting conditions, the actions of other people, or delayed emergency assistance.
- Possible injuries include, without limitation:
- Strains, sprains, soreness, and overuse injuries;
- Bruising, cuts, pinching, and impact injuries;
- Falls and loss of balance;
- Joint, muscle, tendon, ligament, spinal, or nerve injuries;
- Aggravation of an existing or undisclosed condition;
- Dizziness, fainting, cardiovascular events, or other medical emergencies;
- Equipment-related injury; and
- In rare cases, permanent disability or death.
To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with entering the Studio, participating in activities, and using equipment, whether supervised or unsupervised, except to the extent a risk cannot lawfully be assumed or waived.
15. Waiver and Release of Liability
15.1 RELEASED PARTIES
“ Released Parties ” means Well Hour, LLC (d/b/a WellHour), the property owner and manager, and each of their respective owners, members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns.
15.2 RELEASE
To the fullest extent permitted by applicable law, you release and discharge the Released Parties from claims, demands, causes of action, damages, losses, costs, and expenses arising from or related to:
- Your presence at or access to the Studio;
- Your participation in Pilates, exercise, or other activities;
- Your use or misuse of equipment or facilities;
- Slips, trips, falls, equipment movement, or physical exertion;
- Your failure to follow instructions or disclose relevant health information;
- The acts or omissions of other Members or unauthorized persons; and Negligence of a Released Party.
15.3 MEMBER RESPONSIBILITY FOR CLAIMS CAUSED BY MISCONDUCT
You are responsible for claims, losses, or costs resulting from your intentional misconduct, unauthorized access, violation of these Terms, or damage caused by your misuse of the Studio or its equipment.
16. Member Conduct
Members must behave respectfully and safely. Prohibited conduct includes:
- Harassment, discrimination, threats, intimidation, or abusive behavior;
- Sexual misconduct or unwelcome conduct;
- Fighting, reckless behavior, or intentional disruption;
- Smoking, vaping, or use of illegal substances;
- Entering or exercising while impaired;
- Theft, vandalism, or unauthorized removal of property;
- Permitting unauthorized entry;
- Commercial activity, solicitation, or instruction without written authorization;
- Excessive noise or conduct that interferes with another Member’s use;
- Bringing an animal into the Studio except as required by applicable disability law; and
- Violating health, safety, hygiene, equipment, or access rules.
Call 911 if there is an immediate threat. Report non-emergency conduct concerns through the App or to hello@wellhour.co with the subject line “Conduct Concern.”.
17. Equipment and Property Damage
You must promptly report damaged, malfunctioning, or unsafe equipment and discontinue using it.
You may be charged the reasonable cost of inspection, repair, replacement, cleaning, or other loss caused by your intentional act, reckless conduct, prohibited use, or failure to follow clear instructions. Ordinary wear and tear will not be charged to a Member.
The Studio may suspend access while it investigates equipment damage or a safety incident.
18. Personal Property
You are responsible for your personal property. The Studio is not responsible for loss, theft, disappearance, or damage to phones, wallets, clothing, jewelry, vehicles, or other items.
Do not leave valuable items unattended. Items left behind may be donated or discarded after 30 days.
19. Photos, Video, and Privacy
19.1 MEMBER PRIVACY
Members must respect the privacy of others. You may not photograph, film, livestream, or record another person without that person’s express consent.

Recording must not interfere with access, safety, or equipment use. The Studio may prohibit any recording at its discretion.
19.2 STUDIO USE OF IMAGES
The Studio will not use a Member’s recognizable image, voice, testimonial, or likeness for advertising or promotional purposes without separate consent, except for security footage.
19.3 SECURITY SYSTEMS
The Studio will use access logs and security cameras in entrances, exercise areas, or other lawful locations for safety, security, access control, incident investigation, and property protection. Cameras will not be placed in restrooms, changing areas, or other locations where a person has a heightened expectation of privacy.
20. Suspension and Termination
20.1 Suspension or Termination by the Studio
The Studio may warn, restrict, suspend, or terminate a membership or access
privileges for:
- Nonpayment or disputed charges;
- A third Late Cancellation or No-Show incident under the three-strike policy;
- Unsafe equipment use;
- Failure to complete required onboarding;
- Sharing access credentials or admitting unauthorized persons;
- Harassment, threats, illegal activity, or misconduct;
- Damage to equipment or property;
- Material misrepresentation of account or health information;
- Violation of these Terms or posted rules; or
- Conduct that threatens safety, security, privacy, or operations.
20.2 IMMEDIATE ACTION
The Studio may act without advance notice when necessary to address an immediate safety, security, fraud, payment, or misconduct concern.
For a less serious violation, the Studio may provide notice and an opportunity to correct the issue, but it is not required to do so where the conduct is repeated or substantial.
20.3 EFFECT OF TERMINATION
Termination ends booking and access rights. Unless expressly approved by the Studio, termination for a Member’s violation does not entitle the Member to a refund of fees or unused credits.
Termination does not eliminate amounts already owed or provisions intended to survive termination, including payment obligations, releases, property-damage responsibility, dispute provisions, and governing law.
21. Changes to These Terms
The Studio may revise these Terms to reflect operational changes, safety practices, technology, pricing, legal requirements, or membership policies.
The Studio will provide notice of material changes via email or through the App. Changes will take effect on the stated effective date.
Continued use of the Studio after the effective date constitutes acceptance of the
revised Terms. If you do not agree to a material revision, you may cancel the
membership in accordance with Section 11.
Changes to these Terms must be confirmed in writing by an authorized representative of the Studio.
22. Electronic Communications and Signatures
You consent to receive membership notices, billing communications, policy updates, safety notices, and other Studio communications electronically via email or through the App.
Electronic acceptance, initials, check-box consent, and electronic signatures have the same effect as handwritten signatures to.
23. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or Studio use must be brought in Milwaukee County Circuit Court in the State of Wisconsin, and the parties consent to the jurisdiction of those courts, unless applicable law requires otherwise.
Before filing a non-emergency claim, the parties agree to attempt in good faith to resolve the dispute by written notice and informal discussion for at least 30 days.
If the Studio is the prevailing party in any dispute (whether resolved informally or through litigation), the Studio is entitled to recovery of its actual attorneys’ fees and costs.
24. General Provisions
24.1 ENTIRE AGREEMENT
These Terms, the signed waiver, membership selection, and any policies expressly incorporated by reference constitute the agreement between the Studio and the Member concerning membership and Studio use.
If a membership-specific written offer conflicts with these Terms, the membership-specific offer controls only as to the expressly conflicting term. The waiver and safety
obligations remain effective unless expressly modified in a signed writing.
24.3 SEVERABILITY
If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.
24.4 NO WAIVER
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
24.5 ASSIGNMENT
Members may not transfer their rights or obligations. The Studio may assign these Terms in connection with a sale, reorganization, relocation, or transfer of its business.
24.6 FORCE MAJEURE
The Studio is not responsible for delay, interruption, or closure caused by events beyond its reasonable control, including severe weather, utility or internet failures, public emergencies, governmental orders, fire, natural disasters, or building conditions. Any credits or refunds arising from an extended closure will be determined under applicable law and the Studio’s announced policy.

26. Member Acknowledgment and Acceptance
By signing or accepting electronically, I acknowledge and agree that:
- I have read and understood these Terms;
- I have had the opportunity to ask questions before accepting them;
- I understand that Pilates and equipment use involve risks;
- I voluntarily assume the risks described in these Terms;
- I agree to the waiver and release of liability to the fullest extent permitted by law;
- I understand that the Studio may be unstaffed or have limited supervision;
- I will complete the required safety orientation before using equipment;
- I will follow all safety, access, booking, and conduct rules;
- I authorize recurring monthly charges and applicable fees as described above;
- I understand the 6-hour cancellation deadline and three-strike policy; and
- I understand that no Studio communication constitutes medical advice.
